The other person is mistreating my parents. Is this grounds for divorce?
If the other party mistreats my parents, it is one of the grounds for divorce in court under Article 840 of the Civil Act.
There is a possibility that it may fall under item 4, ‘when one’s immediate ascendant has been treated extremely unfairly by her spouse.’
However, the court ruled that the cause of divorce under Article 840, Paragraph 4 of the Civil Act was ‘the loss of one’s lineal ascendant
from his or her spouse.
‘When you have been treated severely unfairly’ means that a lineal ascendant of one of the parties has been treated unfairly by the spouse of the other party.
If you have been assaulted, abused, or seriously insulted to the extent that it would be considered harsh to force you to continue.
Since it is ruled that my spouse simply mistreated my parents, it is difficult to say that it falls under this ground.
however!! Conflicts arise as the other person mistreats my parents, and as a result, the couple lives together.
If a relationship breaks down beyond repair, it is difficult to force the marriage to continue.
In cases where unbearable pain is caused to one spouse, Article 840, Paragraph 6 of the Civil Act
‘When there are serious reasons that make it difficult to continue the marriage’ could be grounds for divorce.
